The U.S. Supreme Court ruled Tuesday that it will not hear appeals from abortion clinics challenging a Pennsylvania law mandating ambulatory surgical centers, striking a blow to one of the nation's major legislative vehicles for restricting the procedure nationwide.
In a 5-to-4 decision, the high court turned away a challenge from the Pennsylvania Alliance of Planned Parenthood Providers and its president, Joanne Hoffman.
The decision was not an outright rejection of the law, which was enacted in 2011 by state lawmakers who argued that it would ensure access to health services for poor women. But it did mean that for the moment it could not be used as a vehicle for federal abortion restrictions.
At the same time, that might not be long enough for opponents of abortion. Just four months ago, the court's conservative majority was seen in court-watchers' eyes as ready to take a major step toward overturning abortion rights. Now those conservatives are in a mood to see just how far they can go without having to rely on a court with five of them and a majority four of them.
"If we continue that trend, will have essentially abolished abortion in the United States," Justice Clarence Thomas said in a dissenting opinion.
Justice Anthony M. Kennedy wrote that the majority's decision not to hear the case indicates that it is "not willing to strike down" the 2010 law and that, although it ruled against several provisions in a challenge to the law, nation's highest court left untouched similar laws in several other states.
The challenge was filed in July by clinics around the country that said they had trouble finding an adequate ambulatory surgery center, particularly in rural communities without one.
